Little Remedies® Mom Blogger Contest

No purchase necessary. A purchase will not improve your chances of winning. Void where prohibited. The Little Remedies® Mom Blogger Contest is sponsored by Prestige Brands, Inc. ("Prestige"). Open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older.

  1. Sponsor: The Little Remedies® Mom Blogger Contest (the "Contest") is sponsored by Prestige Brands, Inc. ("Prestige"), 90 N Broadway, Irvington, NY 10533.
  2. Contest Period: The Contest begins on March 10, 2010, 12:00:01 p.m. ET and ends 11:59:59 a.m. ET on April 26, 2010 (the "Contest Period"). The Contest Website's database clock will be the official timekeeper for the Contest.
  3. Eligibility Criteria: Entrant must be a legal resident of the 50 United States or the District of Columbia, who is 18 years of age or older at the time of entry. Employees, officers and directors of Prestige, and its respective affiliates, parents, subsidiaries, advertising, promotion and service agencies, including Elwell Associates, Inc., and members of the immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) and individuals living in the same household of such individuals (whether related or not) are not eligible to enter. The Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws.
  4. Entry: During the Contest Period, you may enter at the Contest Website at LittleRemedies.com. Complete and submit the Entry Form provided on the Contest Website, i.e., your real name, email address, your blog's name and URL, as well as verification that you are 18 years or older. The submission may not contain obscene, lewd or inappropriate images or text as determined in Prestige's sole discretion. Prestige has the sole discretion to determine whether a submission qualifies as an entry. Any entry not in compliance with these Official Rules will be disqualified. All blog entries must be the sole, original work of the entrant and entrants may not have won any previous awards or competitions offered by Prestige. PRESTIGE SHALL HAVE THE RIGHT TO DISPLAY THE ENTRANT'S NAME, LOCATION, AND URL WITH APPROPRIATE LINKS WITHOUT APPROVAL OF THE ENTRANT. NORMAL INTERNET ACCESS AND USAGE CHARGES IMPOSED BY ENTRANT'S ONLINE SERVICE WILL APPLY. LIMIT ONE ENTRY PER PERSON. NO INFORMATION REGARDING ENTRIES OR JUDGING, OTHER THAN AS OTHERWISE SET FORTH IN THE OFFICIAL RULES, WILL BE DISCLOSED. EACH ENTRANT GRANTS TO PRESTIGE THE RIGHT TO USE, PUBLISH, AND BROADCAST HIS/HER NAME, VOICE, PICTURE, PORTRAIT, IMAGE AND LIKENESS IN ALL MEDIA AND TYPES OF ADVERTISING AND PROMOTION, INCLUDING ON THE WORLDWIDE WEB WITHOUT COMPENSATION INTO PERPETUITY. EACH ENTRANT AGREES THAT ALL RIGHTS TO THE BLOG SUBMITTED IS HIS/HER BLOG, AND THE BLOG DOES NOT INFRINGE, MISAPPROPRIATE OR VIOLATE THE RIGHTS OF ANY THIRD PARTY INCLUDING, BUT NOT LIMITED TO, COPYRIGHT, TRADEMARK, OR OTHER INTELLECTUAL PROPERTY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION, OR PORTRAYAL IN A FALSE LIGHT. NO COPYRIGHTED MUSIC, TRADEMARKS, BRANDS, OR OTHER INTELLECTUAL PROPERTY NOT OWNED BY THE ENTRANT MAY BE USED IN ENTRY. SUCH USE WILL IMMEDIATELY DISQUALIFY THE ENTRY. ANY ENTRY DEEMED UNSUITABLE WILL BE DISQUALIFIED IN PRESTIGE'S SOLE DISCRETION. BY PROVIDING ENTRY INFORMATION, EACH ENTRANT ACKNOWLEDGES THAT PRESTIGE MAY ALSO SEND HIM/HER INFORMATION, SAMPLES, OR SPECIAL OFFERS IT FEELS MAY BE OF INTEREST ABOUT LITTLE REMEDIES® OR OTHER COMPLEMENTARY BRANDS FROM PRESTIGE.
  5. Prize/Approximate Retail Value/Odds of Winning: One (1) Grand Prize at a total value of approximately $1,300 will be awarded, consisting of $1,000.00, a Gift Kit, a box of Dancing Deer® Bakery products, and a bouquet of flowers from Flowerbud.com. An additional nineteen (19) First Place prize winners will receive a Gift Kit having a retail value of approximately $125.00. All twenty (20) Prize winners will be featured in the LittleRemedies.com website blogroll for an unspecified period of time. Neither Prestige nor Elwell Associates, Inc. has made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any Prize and specifically disclaims all such warranties, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. The Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND. Odds of winning depend on the number of eligible entries received.
  6. Judging: All eligible entries will be judged on or about May 10, 2010 at Dallas, TX by Elwell Associates, Inc., an independent agency, to determine twenty (20) Winners. Selection will be based on Mom Blogger "votes" from visitors ("Fans") to the Little Remedies® website. Each Fan is permitted to vote once per day for the duration of the contest. One (1) Grand Prize will be awarded to the Mom Blogger receiving the most votes; and the 19 Mom Bloggers receiving the most votes after the Grand Prize winner vs. all other Mom Blogger entrants will receive First Prizes. Decisions of the judges are final with respect to all matters relating to this Contest.
  7. Winner Notification: Elwell Associates, Inc. will make two (2) attempts to contact the potential winners on or about May 10, 2010 at the e-mail address listed on the entry form. If, after two (2) attempts, contact has not been made, the Prize will be forfeited by the potential winner and an alternate Prize winner will be selected. The Grand Prize winner will then be required to sign and return by mail or courier an Affidavit of Eligibility and Publicity and Liability Release (where legal) and assignment of rights within three (3) days of notification or the Prize will be forfeited and an alternate Prize winner may be determined. The Affidavit will be electronically mailed to the Grand Prize winner. Prize winners will return the signed Affidavit to Elwell Associates, Inc., 11300 N Central Expy, Ste 100, Dallas, TX 75243. Prize winners may also be required to complete additional releases provided by Prestige in connection with the Prize. The non-cash Prizes are not redeemable for cash or transferable. No Prize substitutions are allowed. Income, sales and other taxes (and the reporting thereof) related to the Prize are the winner's sole responsibility. It is the winner's responsibility to understand and abide by any federal, state, local or foreign tax laws that may apply to receipt of a Prize. All winners may be required to complete certain Internal Revenue Service tax information reporting forms before or upon receipt of a Prize. The Grand Prize Winner must have the Affidavit notarized prior to return.
  8. General Rules: Unless otherwise prohibited by law, submission of entries constitutes permission to use the entrant's name, likeness, biographical information, entry submission, statements and if applicable, any advertising materials developed, for advertising, trade, promotional and publicity purposes, without compensation. Contest participation constitutes permission for Prestige to share the entrants' information with any of its agents or promotional partners (for prize fulfillment and future marketing programs). All entries will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Proof of entering information at the Contest Website is not considered proof of entry delivery to or receipt by Prestige. The potential winner may be required to provide Prestige with proof that he/she is the authorized account holder of the e-mail address and blog address associated with the winning entry. Internet entries must be made by the entrant only at the Contest Website. Entries made by any other individual or any entity, and/or originating at any other Website or e-mail address, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest. The use of any device to automate the entry process is prohibited. Prestige reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry or voting process or the operation of the Contest or Contest Website; violates the Official Rules or submission guidelines outlined at/on the Contest Website; or acts in an unsportsmanlike, disruptive or inappropriate manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PRESTIGE RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Prestige and its agents are not responsible for technical, hardware, or software malfunctions, telephone failures of any kind, lost or unavailable network connections, lost, late, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate or by any human error which may occur in the processing of the submissions or votes in this Contest. Prestige reserves the right to cancel the Contest if it becomes technically corrupted, and determine the Prize winner from eligible entries received prior to cancellation. Entrants agree to be bound by these Official Rules and the decisions of Prestige and judges, which are final and binding.
  9. Limitation of Liability/Indemnity: EACH ENTRANT INDEMNIFIES AND HOLDS HARMLESS PRESTIGE, ELWELL ASSOCIATES, INC., THEIR SUBSIDIARIES AND AFFILIATES AND ADVERTISING OR FULFILLMENT AGENCIES AND THEIR ASSIGNS AND LICENSEES (COLLECTIVELY, THE "PROMOTIONAL ENTITIES") AND THEIR OWNERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR ANY DAMAGE OR LOSS OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE CONTEST OR THE AWARD, ACCEPTANCE, USE OR MISUSE OF ANY PRIZES OR ANY PRIZE-RELATED ACTIVITY. EACH ENTRANT HEREBY RELEASES AND DISCHARGES THE PROMOTIONAL ENTITIES AND THEIR OWNERS, DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES FROM ANY AND ALL CLAIMS AND DEMANDS ARISING OUT OF OR IN CONNECTION WITH HIS OR HER USE OF THE CONTEST ENTRY, USE OF ANY PRIZE OR ANY ADS DEVELOPED, INCLUDING BUT NOT LIMITED TO, ANY CLAIMS FOR DEFAMATION, INVASION OF PRIVACY OR RIGHT OF PUBLICITY AND CLAIMS, INJURIES, LOSSES OR DAMAGES OF ANY KIND RESULTING FROM CONTEST PARTICIPATION OR ANY CONTEST RELATED ACTIVITY, OR THE AWARDING, ACCEPTANCE, USE, MISUSE, POSSESSION, LOSS OR MISDIRECTION OF ANY PRIZE, OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY. THE PROMOTIONAL ENTITIES AND THEIR OWNERS, DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES SHALL HAVE NO LIABILITY FOR ANY INDIRECT, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF OPPORTUNITY OR GOODWILL. IN ALL EVENTS, THE SOLE MAXIMUM LIABILITY OF THE PROMOTIONAL ENTITIES AND THEIR OWNERS, DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES SHALL BE LIMITED TO THE APPROXIMATE RETAIL VALUE OF THE PRIZES SET FORTH HEREIN.
  10. Winner List: For the name of the winners, available after June 15, 2010, send a self-addressed, stamped envelope to: Little Remedies® Mom Blogger Contest Winners, c/o Prestige Brands, Inc., 10455 N Central Expy #109-254, Dallas, TX 75231.

Governing Law/Jurisdiction: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR PRESTIGE IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS.
